Terms of Service

These Terms of Service ("Terms") govern your use of the Hearth mobile application and relay service ("Service") operated by Verge Labs ("we", "us", "our"). By installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Hearth is a permission relay and supervision service for AI agents running on your personal computers. It forwards permission requests from AI software to your mobile device, allowing you to approve or deny actions remotely, and streams real-time activity data (actions taken, tool outputs, and transcript entries) to the app for your review.

Hearth does not execute commands, modify files, or control any AI agent directly. All actions taken on your systems are initiated by the AI software you have installed and configured. The Service relays and logs permission requests and your responses; it does not act on your systems independently.

2. Your Responsibilities

  • You are responsible for every action you approve. When you tap "Allow" or "Always Allow," the AI agent will proceed with the requested action on your systems. Review each request carefully before approving.
  • You are responsible for the rules you create. Auto-approve rules — whether created by tapping "Always Allow," through direct rule management, or via plugin installation — cause future matching actions to proceed without prompting you. Overly broad rules may result in unintended actions. Review your rules periodically in the Grants tab.
  • You are responsible for the security of your device. Anyone with access to your iPhone can approve or deny agent requests on your behalf. Use device passcode and Face ID/Touch ID to protect it.
  • You are responsible for your data and systems. Maintain backups of important files before authorizing AI agents to work on them. AI agents can modify, delete, or move files; Hearth does not back up or recover data on your behalf.
  • You must not use the Service for any unlawful purpose or in a way that violates applicable laws or regulations.
  • You must not attempt to circumvent, reverse-engineer, or interfere with the Service's permission enforcement mechanisms.

3. Third-Party AI Software

Hearth works with third-party AI agents and models (such as Claude by Anthropic, Gemini by Google, and others). Hearth is independent of and not affiliated with, endorsed by, or sponsored by any AI provider. Your use of those AI tools is governed by their own terms of service and privacy policies, which you accept separately. We are not responsible for the behavior, outputs, or actions of any AI model or agent you run through Hearth.

4. Subscription and Payment

Hearth offers a free tier and a Pro subscription with additional features. Pro subscriptions are billed through Apple's App Store or Google Play and subject to those platforms' terms:

  • iOS: Managed through your Apple ID. Cancel any time in Apple ID settings. Refunds are governed by Apple's refund policy.
  • Android: Managed through your Google account. Cancel any time in the Google Play app. Refunds are governed by Google's refund policy.

We do not receive or store your payment card information. All billing is processed by Apple or Google.

5. Service Availability

We aim to keep the relay service running at all times, but we do not guarantee uninterrupted availability. The Service may be unavailable due to maintenance, outages, updates, or events outside our control. If the relay server cannot be reached, pending permission requests will time out and the requested action will be denied by default — your agent will not proceed without a response.

6. Assumption of Risk

You acknowledge and accept that:

  • AI agents can perform powerful and potentially irreversible actions on your systems, including reading, modifying, moving, or deleting files; executing commands; accessing the network; and interacting with third-party services.
  • By approving actions — individually or via auto-approve rules — you take full responsibility for the consequences of those actions on your data and systems.
  • Notification delivery depends on your internet connection, your mobile carrier, and platform push services (APNs on iOS, FCM on Android). Delays or failures in notification delivery may occur and are outside our control.
  • AI models can behave unexpectedly. Hearth relays the permission requests those models generate; it does not interpret, validate, or constrain AI model behavior.

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERGE LABS AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, FILES, PROFITS, GOODWILL, OR SYSTEM INTEGRITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Without limiting the above, we expressly disclaim liability for:

  • Any damage, data loss, or unintended changes resulting from actions you approved through the Service, including via auto-approve rules.
  • Any actions taken by AI agents running on your systems, whether or not those actions were approved through Hearth.
  • Any harm from service interruptions, notification delivery failures, or missed alerts.
  • Any unauthorized access to your device, account, or computer systems.
  • The behavior, outputs, or reliability of any third-party AI model or software used with Hearth.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00).

8. Indemnification

You agree to defend, indemnify, and hold harmless Verge Labs and its officers, employees, contractors, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) any actions taken by AI agents you approved or that were covered by auto-approve rules; or (d) your violation of any applicable law or third-party rights.

9. Account Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. On termination, your right to use the Service ends immediately. Sections 6, 7, 8, 10, and 11 survive termination.

10. Changes to These Terms

We may update these Terms from time to time. We'll post the updated Terms here with a new "Last updated" date and, for material changes, will make reasonable efforts to notify you. Continuing to use the Service after the effective date means you accept the new Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts of San Francisco County, California, and you consent to that jurisdiction.
